INTRODUCTION
Minnesota is known for its beautiful lakes, rivers, and outdoor recreational opportunities. Whether you are fishing, hunting, or simply enjoying a day on the water, you may wonder whether it is legal to carry a firearm on a boat.
The short answer is yes, but there are important restrictions. Minnesota law allows firearms on boats under certain circumstances. However, the rules depend on whether the firearm is being carried for personal protection, transported, or used for hunting.
UNDERSTANDING MINNESOTA FIREARM LAWS ON BOATS
In Minnesota, carrying a firearm on a boat is generally subject to many of the same laws that apply to carrying firearms elsewhere in the state.
Under Minnesota Statutes §624.714, individuals generally need a valid permit to carry a pistol in public unless an exception applies. This requirement can extend to public waterways.
However, individuals who are legally transporting firearms or participating in lawful hunting activities may fall under different statutory exceptions.
DO YOU NEED A PERMIT TO CARRY A FIREARM ON A BOAT?
If you plan to carry a pistol for personal protection while boating, Minnesota law generally requires a valid permit to carry.
However, Minnesota Statutes §624.714, subdivision 9, provides exceptions, including when a person is:
Carrying a pistol on Minnesota waters for lawful hunting or target shooting in a safe area.
Transporting an unloaded pistol in a closed and fastened case, gunbox, or securely tied package.
These exceptions do not eliminate other restrictions on firearm possession or use.
WHAT ABOUT FIREARMS USED FOR HUNTING?
Minnesota allows firearms to be used from boats during certain hunting activities, including waterfowl hunting. However, hunters must follow specific regulations.
For example, when hunting migratory waterfowl from a motorboat, the boat must be stopped, the motor turned off, and any sails furled before shooting. Additional restrictions apply to hunting locations and firearm transportation.
Hunters should always review the Minnesota Department of Natural Resources regulations before heading onto the water.
WHAT HAPPENS IF YOU VIOLATE MINNESOTA’S FIREARM LAWS?
Carrying a pistol on a boat without the required permit or a valid legal exception can result in serious criminal consequences.
Under Minnesota Statutes §624.714, a first offense is generally classified as a gross misdemeanor, while a second or subsequent offense is a felony.
Depending on the circumstances, additional charges may arise from unlawful firearm possession, transportation, or use. A conviction can also affect an individual's future firearm rights.
